Hazardous Materials Inspections - CUPA

The Roseville Fire Department serves as a Certified Unified Program Agency (CUPA). In this capacity, it provides a number of services to the citizens and businesses of Roseville, including:

  • Consulting on how to safely store and use hazardous materials
  • Responding to hazardous materials complaints or emergencies
  • Conducting inspections of facilities which store chemicals, or generate hazardous waste
  • Reviewing construction/remediation plans involving hazardous materials or wastes
  • Enforcing the Stormwater Management Program in coordination with the Environmental Utilities Department

Programs

As the CUPA, the Roseville Fire Department is responsible for implementing the following programs:

Hazardous Materials Management Plans/Business Plans

Hazardous materials management and business plans are an important part of the CUPA Program. These plans provide critical information about chemicals for emergency responders, as well as the community. Listed below are forms or guidance literature to help businesses comply with hazardous materials regulations. The Roseville Fire Department also accepts the California State Unified Program Consolidated Form for business plans. The Unified Program Consolidated Form may be downloaded from the California Environmental Protection Agency website. Hard copy forms are also available in the office at 401 Oak St., #402, Roseville. The quantity threshold which requires a business plan is 55 gallons, 500 pounds or 200 cubic feet of gas. A storage permit is required for lesser quantities depending on the characteristic of the material. Please inquire about applicable state and local fees, and note the requirement for signature and date on the owner / operator identification page by the responsible reporting person. Section 107a (new section), titled the “PRIMARY NAICS”, is also required to be filled out on the Owner / Operator Identification page.This number is the North American Industry Classification System (NAICS), can be found from a search for your type of industry on their web page.

Underground Storage Tanks (UST)

The Roseville CUPA maintains records of and inspects underground storage tanks (UST's). All UST's are required to meet current state regulations. Permits are required for the installation, removal or modification of such systems. Listed below are forms to assist businesses in complying with underground tank regulations. Steve Anderson can be reached by phone at (916)774-5821 or by email at sanderson@roseville.ca.us for more UST information.

Vapor recovery process, requirements, and information:

The California Air Resources Board (CARB) requires the installation of Enhanced Vapor Recovery Systems (EVR) on retail and non-retail underground storage tanks. Additionally, in-station diagnostics (ISD) is required, for those stations that pump greater than 600,000 per year. In station diagnostics alerts the station operator of a vapor recovery system failure. The deadlines for existing facilities to comply with these requirements are:

  • April 1, 2009, Phase II EVR for all stations
  • April 1, 2010, Phase II EVR with ISD for stations pumping greater than 1.8 million gallons/year
  • September 1, 2010, Phase II EVR with ISD for stations pumping between 600,000 gallons/year and 1.8 million gallons/year

The CARB has certified two Phase II EVR systems manufactured by Franklin Fueling/Healy and Vapor Systems Technologies (VST). More information on EVR vapor recovery systems is available at the California Air Resources Board Enhanced Vapor Recovery Information For Permitting Agencies. Underwriters Laboratory (UL) has approved the Healy Clean Air Separator (CAS) with ISD system. More Information on the installation, operation, and maintenance of the Healy system may be found at the CARB website. Information on the VST system may be found at CARB website. Installation of these systems or any other Phase II EVR modifications must comply with the Roseville Fire Department requirements. Aboveground Storage Tanks (AST)

The Roseville CUPA is authorized to ensure that businesses, which are impacted by the State Above Ground Storage Tank regulations, have a Spill Prevention and Countermeasure Plan in place. More information concerning this requirement may be obtained through the State Water Resources Control Board website. Businesses intending to install aboveground fuel storage tanks in Roseville are also subject to pertinent requirements in the California Fire Code. Listed below are forms to assist businesses in complying with aboveground tank regulations.

Hazardous Waste Generators / Tiered Permitting

The Roseville CUPA maintains records and conducts inspections of businesses that generate hazardous waste or that treat hazardous waste on-site within the City of Roseville. Generators that store less than the business plan threshold quantity of hazardous materials are required to obtain a permit, post emergency procedures and submit a copy of a brief Contingency Plan. Businesses that treat hazardous waste under Permit by Rule, Conditional Authorization, or Conditional Exemption, must complete a notification form and submit it to the Roseville CUPA. The notification form is referenced below, but may also be downloaded from the California Environmental Protection Agency website. California Accidental Release Prevention Program (CalARP)

The Roseville CUPA implements the California Accidental Release Prevention Program (CalARP) within Roseville city limits. This program affects businesses that store or use certain hazardous materials in excess of threshold quantities that may have off-site consequences if released. The program requires an assessment of the off-site hazard potential, and the implementation of a program to minimize the risk of release. Businesses that are required to prepare a Risk Management Plan for the Environmental Protection Agency pursuant to 40 Code of Federal Regulations (CFR), Part 68, are also required to submit a copy of their Risk Management Plan to the Roseville Fire Department.

The regulations for this program, the list of hazardous materials and their threshold quantities, may be found on the California Office of Emergency Services website. CalARP is California's version of the federal Risk Management Plan Program authorized under the Clean Air Act and found in 40 CFR Part 68.
